4. Free Inspection Terms

4.1 Scope of Free Inspection

Our free roof inspection includes a visual examination of the accessible portions of your roof, gutters, flashing, and attic ventilation. The inspection is conducted by a certified roofing professional and includes a written report with findings and recommendations.

The free inspection is provided with absolutely no obligation to purchase any Services from American Roofing Elite. You are under no pressure to commit to any work following the inspection. However, we reserve the right to limit the number of free inspections per property or per customer.

5. Estimates and Proposals

5.1 Written Estimates

All project estimates are provided in writing and are valid for a period of 30 days from the date of issuance, unless otherwise specified. Estimates are based on the information available at the time of inspection and may be subject to change if concealed conditions are discovered during the course of work.

5.2 Price Adjustments

In the event that concealed damage, structural issues, or code violations are discovered during the project that were not visible during the initial inspection, we will provide a written change order detailing the additional work required and associated costs. No additional work will be performed without your prior written approval.

6.1 Contract Execution

All roofing projects require a signed written contract between you and American Roofing Elite. The contract will specify the scope of work, materials to be used, project timeline, total cost, payment schedule, and warranty terms. No work will commence until the contract is fully executed and any required deposits are received.

Financing options are provided through third-party lenders unaffiliated with American Roofing Elite. We act solely as a facilitator and do not make lending decisions. All financing terms, including interest rates, payment schedules, fees, and credit requirements, are determined solely by the third-party lender. You are responsible for reviewing and understanding all financing documentation before execution.

7. Warranties and Guarantees

7.1 Workmanship Warranty

American Roofing Elite provides a workmanship warranty on all installation and repair services. The specific duration and terms of the workmanship warranty will be detailed in your contract. This warranty covers defects in installation and workmanship but does not cover:

Roofing materials are covered by manufacturer warranties as specified by the material manufacturer. These warranties are separate from our workmanship warranty and are subject to the manufacturer's terms and conditions. We will provide you with all applicable manufacturer warranty documentation upon project completion.

7.3 Warranty Claims

To file a warranty claim, you must contact us in writing within the warranty period, describing the nature of the defect and providing photographic evidence if possible. We will inspect the claimed defect within 14 business days of receiving your claim. If the claim is validated, we will repair or replace the defective work at no additional cost to you, subject to the terms of the applicable warranty.

8. Insurance and Liability

8.1 Insurance Coverage

American Roofing Elite maintains comprehensive general liability insurance, workers' compensation insurance, and commercial auto insurance as required by law. Certificates of insurance are available upon request.

8.2 Property Damage

We take reasonable precautions to protect your property during the course of work. However, roofing work involves inherent risks. In the event of accidental damage to your property caused by our negligence, we will repair or compensate you for such damage, subject to the limits of our insurance coverage. We are not liable for pre-existing conditions or damage caused by factors beyond our reasonable control.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMERICAN ROOFING ELITE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO AMERICAN ROOFING ELITE FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, OR DAMAGE TO PERSONAL PROPERTY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Cancellations and Refunds

9.1 Cancellation by Customer

You may cancel your contract within three (3) business days of signing without penalty, in accordance with the Federal Trade Commission's Cooling-Off Rule (16 CFR Part 429). Cancellation must be made in writing and delivered to our office address or via email to contact@americanroofingelite.com. If you cancel within this period, any deposit paid will be refunded in full within 10 business days.

After the three-business-day cooling-off period, cancellation is subject to the terms specified in your contract. Typically, you will be responsible for costs incurred up to the date of cancellation, including materials ordered, permits obtained, and labor performed.

9.2 Cancellation by Company

We reserve the right to cancel or postpone any project due to circumstances beyond our reasonable control, including but not limited to severe weather, material shortages, safety concerns, or failure to receive required permits. In such cases, we will refund any deposits paid, less costs already incurred, within 10 business days.

10. Intellectual Property

All content on our Website, including but not limited to text, graphics, logos, images, photographs, videos, software, and code, is the property of American Roofing Elite or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content without our prior written consent.

Our company name, logo, taglines, and service marks are trademarks of American Roofing Elite. Unauthorized use of our trademarks is strictly prohibited and may constitute trademark infringement.

11. User Content and Communications

By submitting reviews, testimonials, photos, or other content to our Website or through our Services, you grant American Roofing Elite a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or have the necessary rights to grant this license and that your content does not violate the rights of any third party.

We reserve the right to remove or refuse to publish any user content that we determine, in our sole discretion, to be inappropriate, offensive, misleading, or in violation of these Terms.

12. Dispute Resolution and Governing Law

YOU AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, PRIVATE ATTORNEY GENERAL ACTIONS, OR OTHER CONSOLIDATED PROCEEDINGS.

You agree to indemnify, defend, and hold harmless American Roofing Elite, its officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our Website or Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to our Website or Services.

14. Force Majeure

American Roofing Elite shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor, or materials, or government restrictions.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with any written contract executed for specific Services, constitute the entire agreement between you and American Roofing Elite regarding the subject matter hereof and supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written.
